2. And no leaks yet?
In today's political climate, leaks are part of the process...including court rulings (and especially court rulings this substantial).

7. Any reason why? Or are you suggesting it won't be pretty regardless of the outcome?

10. Probably because most legal scholars have already chimed in that it will be upheld.
The challenge isn't against Prop 8, but against the process used to change the constitution. Legal eagles of all stripes have been chiming in on the issue for months now, and most have come to the conclusion that the process used to put Prop 8 on the ballot was legal.

The justices will be ruling on the validity of the process first and foremost, and their other rulings will stem from that. A ruling overturning the proposition will make us happy, but would shock most of the legal profession (and undoubtably spawn all sorts of additional suits over other propositions passed using the process, everything from Prop 13 to Prop 98).

12. Maybe.
My gut says it will be upheld, but the existing marriages will be recognized. There will be massive protests... maybe violence.

If it's overturned, the Right could become unhinged. I am wondering what will bring on the next McVeigh or Eric Rudolph.

But I believe that it will be upheld.

25. They ruled on the nature of the proposition, not on same sex marriage.
Edited on Tue May-26-09 12:11 PM by EFerrari
But, they ruled the marriages stand which is excellent.

They say they intend to be arrested; the PD are not moving yet.
