Thurgood Marshall. Clarence Thomas. Barak Obama. Sonia Sotomayor.
what do they all have in common, other than being minorities?

They were all minorities who were attacked as not being "intelligent" enough to hold the offices they aspired to.

They may have been onto something there in Thomas' case :)

The good news is that Thomas seems to know it and keeps his freaking mouth shut.

It's always been this way for black and brown folks in America. If we sit around all day smoking weed and drinking 40s, we're "living up to the stereotype." If we work our asses of and succeed, we're the "AA candidate who only got somewhere because of white liberal guilt/standing on the shoulders of more qualified white men." Damned if we do and damned if we don't.

More at issue, usually, is the view (Obama excepted, since he is not a potential SCOTUS member) they hold of how to interpret the Constitution.

Bork was Caucasian and rejected because he was such a strict interpretist of the Constitution.

Others who are more grounded in Constitutional Law and how selection of Supreme Court justices work than I am can probably help explain the views justices hold and how they differentiate and why this differentiation matters.

But thank you for raising such an important issue.

I just think it is way, way more than race. It goes down to an obsessive belief that one knows the purpose of the "founding Fathers" in crafting the Constitution, and how we are to deal with the discrepancy between how time, society, intelligence and technology have evolved since those very early decision in the 1700s.


ON EDIT:

Term I was searching for was "strict Constructionalist" I think.

26. This was my first reaction: what does not belong here?
I think that Thomas was the only one since the ABA started grading the candidates, who did not get even a "qualified" grade.

16. They did the same thing to Bill Clinton. Tried to depict him as a hillbilly. Really.
The 'fake' routine has always worked. It worked with Gore. It worked with Kerry. It worked with Hillary Clinton, and they're trying to make it work with Obama.

People who are articulate are 'fakes'.

I also post on wingnut boards. Crazy assed veterans. They think Dems are fakes and GWBush is a 'real' guy, hence the campaign mantra 'He says what he means and means what he says'. GWB - to them - was genuine. Bill Clinton was a silver-tongued fake. Same for President Obama.

It won't work. The US likes its president just the way he is. And when they hear the justice nominee, they'll like her too.

than Clarence? Remember staying up til 2:00 a.m. waiting for Biden to put the witness on that would corroborate Anita Hill's testimony? And...in the end Biden announced he was "wrapping up the hearing."

Sorry...those of us defending women's rights (way back there in the dark ages) were up all night watching that and we were disgusted. Look how Clarence (hair on the coke can) turned out for us Dems.

And who ushered Clarence through? Biden and that Dem who turned into a preacher man...who is the "fave" for "Inquirty Hearings" acceptable to both sides.. (I forgot his name) and don't have time to get it from Wiki or Archives but you know who I mean.
