He won't break his tradition of voting for every Justice to the SC during his time in the Senate.

Contessa Brewer reported this.

1. Well, glad to hear it. Had there been some question as to what Byrd would do?

5. I don't see the list of yays and nays on C-Span right now
Earlier, they were showing them during the speeches. Byrd's position was left blank this morning. So I guess his decision to be able to be there to cast his vote was just made.

10. Well, that's enough, isn't it?
Or does the GOP get to filibuster our Court nominees if the majority isn't at least five-to-one?

2. I'd be pissed if any Democrat had to even think about voting to confirm her
she's as qualified a nominee as we've had in the past century.

3. Byrd has been quite ill lately, so the issue was his ability to be there to vote

7. Heath is the issue for sure
He voted against going into Iraq. If he can make it to the Senate floor, even on a gurney, he will be there on important stuff.

8. I need to leave for a bit and would miss the vote on C-Span
So I'm setting up the DVR and will watch it later. I don't want to miss seeing him cast his vote.

4. Yeah, whether the old guy would be able to make it to the floor.
The 91 year old has only shown up for 2 votes since he was released from the hospital over a month ago.
