Legal eagle: Rove, Gonzales facing 'colorable prosecution'
"And I think it's clear that the evidence that's being assembled now, particularly in the New Mexico case, moves this into the area of a colorable prosecution involving Domenici, Heather Wilson—whose testimony, by the way, and statements are viewed by many of the investigators as highly evasive and unlikely—and also Karl Rove and Alberto Gonzales ... who had a general failure of recollection about all of this."

Horton is quick to add, however, that there’s no precedent for such a prosecution.

4. I think I know
I'm no lawyer but I believe it means that the offense can only be an offense under certain circumstance; in this case Rove and others would have had to have been Federal Employees for their activities to be illegal, so what they were doing was being done 'under the color of law' (done from a lawful position) but in fact was illegal.

Like I said, could be dead wrong on this. Someone will tell us both if I am.

5. I was searching for a legal definition,
and I found two apparently conflicting definitions.

From Answers.com law encyclopedia:
"False; counterfeit; something that is false but has the appearance of truth."

"having an appearance of truth, validity, or right if a ⁓ claim — or better — can be pleaded"

I guess we will have to wait for an actual lawyer to tell us... :shrug:

Ok, maybe the Reagan administration was a precedent. But the Bush administration took it to the extreme, as Grenada is to Iraq.
