AMY GOODMAN: So we’re talking about criminal prosecution?

DAVID IGLESIAS: Exactly. And as I understand it, the special counsel, who’s the acting US attorney in Connecticut, she’s looking at possible perjury charges against Gonzales and possible obstruction of justice charges against other members, including possibly Wilson and Pete Domenici.

While there were no big surprises for Iglesias in the newly revealed documents, he was taken aback at how early on the complaints started coming in. "I'm looking at a copy of an email dating back to June of 2005 from Scott Jennings, who worked for Karl Rove, and he writes to Tim Griffin, another staffer for Rove, 'I would really like to move forward ... getting rid of (the New Mexico U.S. Attorney). I was with codel'—which I think is 'congressional delegation'—'this morning, and they are really angry over his lack of action (over the) voter fraud stuff. Iglesias has done nothing. We are getting killed out there."

Iglesias referred to this email as "the smoking gun."

Well, that tells me that—I mean, that is the smoking gun. I failed to file non-provable voter fraud cases, and that was, in large measure, the reason for my removal. They wanted me to file politically advantageous prosecutions, which United States attorneys cannot do legally. And, you know, that set the ball into motion.

Scott Horton weighed in: "David is coming exactly to the right focus in the end. I mean, was it unethical? Yes. Clearly it was the violation of rules. Was it inappropriate? That’s all clear. We're coming down to the question of, was it a crime? And specifically, did it involve an effort to corruptly influence a pending criminal prosecution?

"And I think it's clear that the evidence that's being assembled now, particularly in the New Mexico case, moves this into the area of a colorable prosecution
involving Domenici, Heather Wilson—whose testimony, by the way, and statements are viewed by many of the investigators as highly evasive and unlikely—and also Karl Rove and Alberto Gonzales ... who had a general failure of recollection about all of this."

This was an interview Iglesias gave a couple of days ago, and it's simply his opinion. I think it was on Countdown.

That subject line is hysterical and misleading.

Because the OP is old news, and there's absolutely nothing in the quoted matter that says that anyone's going to be indicted, sooner or later.

It's very reminiscent, though, of the hysteria that surrounded Leopold's "reporting" of the any-moment-now "sealed indictment" of Karl Rove when Patrick Fitzgerald was investigating the Plame matter.

His "reporting" was one set of lies after another, each one more absurd than the last. He made it all up, and so, when allegations that contain no substance, such as the OP are made, it reminds DUers - as it did, and to which I responded - of Jason Leopold.

That's the reputation he's earned for himself................................

And you link a days-old discussion between two folks, neither of them who are in a position to know, and you breathlessly talk about Rove facing prosecution. Sorry - ROVE FACING PROSECUTION.

knew him and interviewed him several times. She believed him. We still do not know what happened. We do know he never gave up his sources, which many believe was what those who went after him, really wanted to know.

would almost make my entire pathetic little life have all been worth it. Slime; both of em . (one bit of hesitancy about being too "bloodthirsty" here: I 've taught 2 of Pete's grandchildren, who were absolutely wonderful kids, but hey , if grampa's a criminal, then he's gotta pay the price). And I also have seen too many "now we got em" moments to have much faith in anything happening to these 2 ,along with anyone but maybe a few patsy underlings of the greater Bush criminal organization , and we'll be lucky to get even that what with the "let's move forward and allow the bastards who shit on the constitution to get away with everything " attitude of the new administration. But damn, if this somehow really happened, it would be mighty sweet here in New Mexico where Domenici actually is referred to as St Pete, and not sarcastically either. He's worshipped by many almost like a local Reagan. Not that Rove and Gonzalez wouldn't be even more sweet, but just looking at this from a local angle.Everyone whose eyes and ears have been open,know what obvious criminals Rove and Gonzalez are, but I just don't have a handle on how well known Wilson and Domenici are outside of NM. But trust me, all you Duers back in civilization, they're SLIME.

41. I just want to laugh wearily. The likelihood of Rove or Gonzales ever being held to account
for their crimes is about as great as the likelihood of Ali Larter showing up at my door wearing only a towel and asking if she can use my shower. I wish I were wrong, but I see no reason to think anyone from the previous administration will ever pay for their crimes.

So I think it’s possible. These things are being studied. But there’s never been a prosecution of this sort before. That is, we’re dealing with a criminal prosecution that was actually brought. This was an effort to influence the timing of the indictment to make it before the election to influence an election. Most legal scholars agree that, yes, in theory, that counts as obstruction of justice, that’s something that could be charged, but there’s no precedent for such a prosecution.

69. NO Doubt-Rove and gang should face fed prosecution for obstruction...
These is NO doubt at all in my mind the Rove and his gang crossed
the line, motivated by political purposes and responding to pressure
they conspired and actually did, in violation of federal law,
interfered with DOJ investigations. Yet the Obama administration
has shown little stomach for these prosecutions and it seems doubtful
these will be pursued at all, much less with necessary vigor.

But what we can really know and count on is that the froth-wing WILL,
when they reemerge to power, fanatically legally prosecute baseless POLITICAL
accusations with the same ferocity they successfully applied in the
early 90s (ie clinton impeachment) to set up the last 8 years.

They WILL eventually repeat that SUCCESSFUL formula of fear and froth mongering
of an clueless base to regain power, dismantle democratic institutions, and loot.

So we know where the repukes stand, we know where Obama stands, We know where WE (DU)
stand. So isn't the real question we need to be asking is what the hell we intend
to DO about what WE want.

Prosecute.

If we can prosecute these two criminals for their terrible assaults upon our democracy and hope they each end up with a "Big Bubba" boyfriend, I can sleep more comfortably at night.
