If you're sick from the product, it's your fault because you were not a smart consumer. The invisible hand of the marketplace will fix everything. What? Your kid just died from lung disease? Well, I guess you won't buy that Chinese drywall anymore.

They just need a few. It's a crap shoot as to what they can convice a jury to award. Plus they might score bg on punitive damages. Especially if they sue some smaller builder or lumber yard that can't afford to put up a good defense.

It's not like there's some big Slot Machine o' Justice standing in the courtroom, and you get a free pull. There are more procedural rules than you can shake a stick at, just to get inside the courthouse door, and punitive damages are delineated by a very circumscribed set of court rulings and precedents that the trial judge, the appellate courts, the state supreme court and the federal Supreme Court can and do modify at any time without warning or pretext.
As for putting up a good defense, I have yet to see the insurance company that couldn't and didn't hire the best lawyers they could afford. Sometimes corporations really do injure people because it's still more profitable to pay the occasional claim that makes it through the litigation maze than it is to reform their business practices to a safe and ethical standard. Hard to believe, I know.
