The administration has already lost this fight for one simple reason, the refusal to educate the masses and more particularly the senate regarding the seperation of powers between the branches.

Bush should simply state that the firing of USAs is an executive branch function and that is that. The legislative branch can hold hearings until the cows come home, but the executive branch will not participate---period. No witnesses, no documents, just laugh in your face, go read the constitution. But, alas....

during the time the Arlen provision was inserted in the Homeland Security Act... Fortunately that's been repealed....

the exclusion of Checks and Balances.

Each branch, while separate, is a check on the other branches, thus providing a balance of power.

At least that's the way it was in old America.

3. The question is of abusing power for political benefit.
One cannot exercise executive branch authority for the sole purpose of political gain. Removing attorneys that would prosecute cases against Republicans would be a clear example of abuse of power.
