amongst other things, "loser pays"
that means that if you file a lawsuit, and you lose, you can be saddled with the costs of the defense.
this discourages frivolous lawsuits
in the US, many deep pockets will settle even IF they think they would probably win, because even if they won, their court costs would mean it's CHEAPER just to settle
it creates perverse incentives.
i could not care less WHO proposes a reform, repubs, dems, anarchists, whatEver.
i care about the validity of the reform
