The use of torture has been banned by President Obama. He just wishes not to divide the country further with prosecutions of the previous administration.

He has sustained the position of the previous administration as of January of 2009 (which had withdrawn the torture memos and stopped the practices). He also reserves the authority to authorize them in the future.
