I don't think he could bear to resign as Sheriff... give it all up for a less than sure thing. Plus he doesn't need any additional scrutiny and delving into his records, etc. I read where the new Sheriff would have opened an investigation, and he can prevent that or at least stave it off for a while, by remaining Sheriff.
