DNC to Free Republic: CEASE AND DESIST!
Edited on Fri May-11-07 08:14 AM by johnfunk
I know, I know -- many of us have been saying it's about f$#@ing time to play hardball with the stooges:
A post by "coffee260" on "Freerepublic.com" today states that this morning, on the "Quinn & Rose" show on XM, co-host Jim Quinn stated that DNC CHJairman Governor Howard Dean had called Gov. Kathleen Sebelius &lquot;around 5:00 a.m. one morning after a tornado had destroyed the town of Greenburg, Kansas and discussed with her what to say["]... The statements quoted above are false and defamatory, are libelous and slanderous... [C]ease and desist from further dissemination of the above-quoted statements or any statements similar in substance and (ii) immediately post a retraction...
Read it all here.

MORE: Looks like these posts are still live on Free Republic, here and here.
MORE MORE! Ha! another -- from Quinn! XM also got hit with a C&D.

20. You'd be surprised
a caller to a progressive talk show in Hartford (CT) yesterday started spouting off about Sebelius and how she was getting talking points from Washington DC... so, if it's made it all the way to a small city in New England, it's been pretty widely circulated.

27. Can I debunk some of the caller's other points, though?
The caller also said that kansas had enough national guard and equipment to do the job.

I'm sure the caller had his facts wrong, but I do like to verify facts before submitting a letter, or following up with a phone call.

But, it does not debunk the Freeper talking point that, while short of equipment overall, the Kansas National Guard had enough equipment to do the job in that town.

10. Who Is Jim Quinn???
Spewing all that venom on the "Satellite of Love" to all the 4 people (including mom & the producer) who were tuned in?

So the sin here is that the Chairman of the Democratic National Committee talked with the Democratic Governor of Kansas and discussed the situation that just happened in her state? How dare he! Whose he think he is? Karl Rove?

Hopefully the fine work of Gov. Sebelius and the arrogance and mismanagement of the boooosh regime is being noted by Kansas voters.

13. Jim Quinn used to be part of the famous - Banana Don and Jim Quinn
morning radio show here in Pittsburgh. Before becoming an esteemed right-wing commentator, he was best known for fart jokes during the rush hour commute. Although the show was cancelled in the late 80's over a sexual harassment suit - who would have guessed.

12. The DNC doesn't have much of a case against the website or the poster if
the radio host actually said this. The only fact that the poster is stating is the radio host said something. If the host did, they the poster is within his rights. OTOH, if the host did say this, the host himself would be liable.

such as this is written or spoken thru the media, that is false and slandereous the same should be done.

I know it is annoying to go thru this, time consuming and expensive but it has to be done. They have to know that their slander won't be tolerated. I just wish someone has the balls to do the same to rush limpaugh and glenn beck, adding CNN to the suit. With the lack of investigation and the stuff they give out as news they should be at the top of the list.

28. They are propagating a provable falsehood
Now that they are aware that the DNC is prepared to demonstrate that Quinn's lying lie is a lying lie by a liar, they have every right to have their lawyers tell FR to yank the lying-lie-based lies in the form of posts.

It's not an uncommon practice in potential libel/slander cases.

29. But they clearly state that this allegation was made by Quinn & Rose.
How is reporting what someone else said, in the context that person Y (and not me) alleged something, libel? I could understand if the poster simply made the allegation himself as opposed to reporting that someone else made the allegation.
It seems like an attempt to suppress news via lawyer, something I never like no matter who is doing it to whom.

Interestingly, the moderators at FR deleted the HotAir excerpt by proven FReeper "legal team" liar and fraud Bryan Hinnen:
Update: Brownback says no, making it 3 for 3.

Update: The DNC just emailed me two documents, one a letter to XM and the other a letter to Free Republic. In both letters, the DNC denies without equivocation that the conversation between Dean and Sebelius ever took place. Both are C&D notices from the DNC’s lawyers.

The statement made by Mr. Quinn is demonstrable, unequivocally, and absolutely false. Governor Dean had no such conversation with Governor Sebelius, ever.

That’s about as flat a denial as one can get, though it’s interesting that they would resort to C&D notices to combat this story and characterize it as “libelous” and “slanderous” and “interfering with the DNC’s operations and ability to solicit support and raise funds.”

Of course, Bryan is being a complete hypocrite because he is a huge fan of "cease and desist" letters, at least when quite clearly hiding behind a sockpuppet identity while trying to intimidate people he disagrees with:
