Which Democrat voted against Kagan? |
|
How have I missed that? I have heard twice in the news that "all but one democrat voted for her", but looking here I don't see any reference.

and he's a DINO. That label gets tossed a lot to the point it has lost a lot of meaning, but in Ben's case he's an actual dinosaur of our party that should be taken to the woodshed like Zell Miller before him.

I see the Supreme Court as the last bastion of true ethnic and cultural diversity.
Sorry but I see the Elena Kagan appointment (another Jewish NYCer from Harvard) as not being in the interests of and about the needed diversity of our country, and our Supreme Court. We needed SC justices from diversified cultures and diversified geographic areas and instead we got more of the same.
Diversity, culture, religious background is the cornerstone of decisions involving justice. You can't have all White Protestant males making the decisions on justice and you can't have the Jewish making up 33% of the Supreme Court decision makers when they only make up 2% of the country.
Our Democracy is about diversity of all and not about diversity of a few.

I didn't know that those of us who desire and believe in full ethnic and cultural diversity can be considered right wingers. Is this a new plank of the Democratic Party?
Can you please explain how less diversity is better than more diversity? Or does less diversity not count sometimes?
If any institution should be about full diversity (gender, religious, cultural, ideological) it should be the US Supreme Court because they are appointed for life and they remain there regardless of their views and views of the country.

What's that you say? There are no Gay Asians from Omaha who attended bible college even nominally qualified to serve in such an important role? How about a multi-ethnic atheist hermaphrodite from Michigan who went to Vassar? None of those either? Shit, we'll have to settle for the spunky outwardly-asexual (though rumored to be a lesbian) New York City Jewish woman who headed Harvard Law School.
Quotas are fucking stupid. The last socially-acceptable vestige of -isms.
I want the nine smartest motherfuckers in the land on the SCOTUS bench...we're screwed on four of those seats and the fifth guy's a somewhat-flaky wildcard who usually votes against us...I'll settle for the four smartest motherfuckers for now and maybe we can get one or two more soon.
Kagan wasn't my first choice either (I wanted an intellectual-heavyweight non-judge like Larry Lessig or Nadine Strossen*)...my first choices both supported her nomination though. Good enough for me and my brainiac quota; that's the only quota I care about. Getting the smartest, best justices we can.
*-some day Ruth Bader Ginsburg is going to retire and if they don't nominate Strossen to replace her, I may go ballistic. I don't care if she's a board member for NORML.

It would have been far better than what we got, which is over-representation of one minority and no representation from others. If you think that the ability to rule on justice is purely about beliefs you are wrong. Perceived justice comes from commonality in background, culture, religion, politics, geography, wealth and everything that forms all of our opinions. Americans will not accept rulings that are based upon the opinions of the few. Kagan has a NE Harvard Jewish culture and that represents but a tiny segment of America.

More's the pity. I work in law, including having worked for some SCOTUS admitted attorneys who aren't white Protestant males from Ivy League schools--this nation would be in a far, far, sorrier state than we are if your fondest SCOTUS wish came true.

the people of the USA and the democracy need representation from more than the just "elites" from the NE and Harvard..wouldn't you agree? Or are those from middle America the less than qualified serfs?
Most Americans can't afford to attend these Ivy League schools but that doesn't mean they should be excluded from our ruling aristocracy. These pretentious Ivy League schools are a club unto themselves and they perpetuate the belief that they alone can rule America. Kagan's appointment just perpetuated that absurd belief as does the overclass status of Goldman Sachs in our government.

So is Jewish culture unique? Or is it the same as Muslim or Protestant or Asian or Catholic, or African American culture?
I suggest you go to Synagogue next Saturday and ask any Jew in attendance if their culture is unique unto Jews and then come back and report the results of your interview. That's why our country and our Supreme Court needed diversity and why a lack of it is very harmful to a democracy.

Chan: NYU Law applicant who grew up in the shade of the ivy in New Haven, CT (and took some summer/continuing-ed courses at Yale to get my GPA up.) born to upper-class white parents. My father's family is Scots-Catholic, my mother's father was a Polish Jew (Nobody knew his parents had been Jewish until he died and we found out he'd known for years.) and my mom's mom was Lebanese-Catholic, her mom was a Mayflower descendant and a Mohegan Indian. The Bushes are very distant cousins on that branch of the tree. I'm a bisexual (female-preferring) atheist who is hard-of-hearing. I'm a leftist, left-handed and have AB- blood. I have a boy-crush on the long-dead John Maynard Keynes. I don't own a TV and I read 50-100 books a year, or 250 pages a day on average.
Or, if I ever get to that point, I could just be assessed on my qualifications to serve and legal expertise.
