US troops 'smiled before killing'

Four US soldiers charged with murdering three detainees in Iraq smiled before shooting them, a military court has heard from a fellow soldier.

Private First Class Bradley Mason told the hearing at a US base near the Iraqi city of Tikrit that one of the accused threatened to kill him if he talked.

He also said soldiers had been ordered to "kill all the male insurgents" in the operation on 9 May of this year. snip

"He {Col Steele} just said that the rules of engagement were that 'we get to kill all the male insurgents'," he said.

Col Steele has reportedly signed a statement declaring his intention to refuse to testify in the case.

In Quang Tri they told us that when we were that far North, ROE was out the window. We were allowed to smoke anyone that wasn't us.

That suggests to me the men charged may be telling the truth about the orders they were given. There has so far been no particular reason to believe them. Such an order is absolutely illegal, and the men should have dis-obeyed it, but giving it is a crime all its own....

Protecting an arrestee or an accused from self-incrimination under interrogation or at trial. How it would apply to the testimony of a witness at a trial, not accused himself of any crime in that proceeding, someone with more knowledge of the matter than mine will have to clarify.
