Maybe some other government could snatch those guys while they're on an overseas trip, or even "render" them from U.S. soil. It seems if the US President can do so simply by calling someone an "enemy combatant," then any other government should be free to determine that any US citizen, these guys included, is and "enemy of humanity" and take whatever measures are required to secure them in a small cell in some undisclosed location to protect the planet.
