Okay: Elena Kagan is the Devil! Got it! |
|
But when our President nominates her, what the hell are we gonna do? See, I agree with most of you here: Personally, I think that she'll end up being the Democratic version of Souter!
Does Obama know the implications? Probably. Does he have his own reasons for this supposedly-imminent nomination? Almost certainly. Do I have a fucking clue as to why he would want this person on the SCOTUS? Do you?
Rhetorical question.

1. The fact that Stevens (a Republican appointee) could even BE the most Liberal member of the Court |
|
is evidence of how horribly unbalanced the court has become over the last 30 years (just as the other two branches of government have also become).
There's no question that Kagan is to the right of Stevens. If she is nominated, a DEMOCRATIC PRESIDENT will be responsible for pushing this court even further to the right.
How is that in any way acceptable?
There are good LIBERAL judges out there. Not as many as there should be, but it shouldn't be that difficult to find one.

8. Leftist! Not only is that hilariously inaccurate |
|
it is also a term used primarily by the right wingers. So enjoy.

9. Or he happens to know her because he worked with her |
|
at the University of Chicago Law School. How that somehow equals string pulling by others I don't know. Is she the right person? Maybe not. But some of the arguments here are getting kind of ridiculous.

10. I'm not into devils and don't think they exist. That would include devils |
|
in the plural or a singular Devil, Lord of the Fire Below, etc.
Devils do have a delightful allegorical kick, true.
But I don't think they're real.
Kagan hasn't been nominated yet. Evidently some outlets are reporting that she is the nominee, but the White House has not announced its choice yet so far as I know.
No matter who is nominated by whichever president, the appointment is for life and no one on earth can stop a confirmed Justice from casting votes this way, that way, or the other way.
Souter was chosen because he was believed to be a reliably conservative vote; that turned out not to be the case.
No one knows now how Kagan or any other nominee would vote on given cases.
