8. No, the original Judge was removed without cause...

Her name and possibly others were left off the list of 'candidates' to replace her. That IS Judge shopping.

10. Lucy Billings was contacted at her home by lawyers for OWS

She was not the judge on after hours duty in the courts last night. The judge on duty, after being contacted later, let her proceed.

The judge for the hearing was selected at random from the slate of judges who would normally hear cases of these type.

"The judge on duty let her proceed." In doing that, it had the effect of handing over the case to her. Removing her without cause after her ruling and, given she had heard and ruled on the case, prohibiting her from being on the list of candidates was Judge shopping.

15. The lawyers for OWS did the shopping by selecting her; Stallman was picked at random

out of the slate of judges who were regular candidates. They just undid the judge shopping of the OWS lawyers.

It is the removal of the Judge without cause and then excluding that Judge, after her having heard AND ruled on the case, from being on the list of candidates that is judge shopping. The judge was qualified to hear the case, the judge on the 'call list' obviously agreed as he/she did not step in after being called, yet she was removed without cause. To equate the lawyers of OWS calling the Judge in hopes she would hear the case being the same as those who REMOVED the judge after her ruling to be the same relative to power is beyond ludicrous.

11. Interesting, the lawyers for OWS are saying....

while the order upholds the 'no tents, structures', there is NO mention of sleeping bags, prohibiting entering the park immediately, staying in the park 24/7.

OWS is appealing this decision which would be expected.
