Strange Twist in Wisconsin Battle
By Lisa Pease = April 8, 2011

...Nickolaus was hardly some computer novice. For seven years, she worked as a data analyst and computer specialist for the Assembly Republican Caucus (ARC), where she managed an effort to build a computer program to track and average the performance of Republicans in elections across the state by ward.

Guess who headed the ARC when Nickolaus performed this work? David Prosser, who was a Republican leader in the state legislature before being appointed to the bench in 1998.

In 2001, the Assembly Republican Caucus was charged with using taxpayer-funded resources to conduct campaign activities, a move that is wholly illegal. Nickolaus was granted immunity to testify about these issues. Prosser himself admitted to leading these activities, but Prosser could not be prosecuted for these criminal activities because the statute of limitations had expired.

Prosser defended his actions by claiming that legislation and politics go hand in hand, and therefore it shouldn’t be illegal to conduct campaign activities with legislative funds.

So we’re being asked to believe that the woman who had recently served as president of the Republican Women of Waukesha County, who had a personal stake in seeing her former boss and a member of her party win, forgot to enter the very data that would have put her candidate over the top in an election where the very future of her party’s role in state government was at stake.

That’s a difficult lump to swallow.

Of course, there is another possibility. What if this hardcore Republican activist, with sophisticated knowledge of computers, who kept the sole election database at home in her personal computer, under her personal control at all times, withheld the results of one city until she knew how many votes were needed to put Prosser over the top?

1. It's not about the numbers, it's about her honesty.
She has a history of criminal activity. She has 13 years experience in voter data manipulation. She has fouled up other elections she was allowed to count. She has been audited for her "mismanagement". She ignored auditors. She is a rabid partisan RepubliCON forced pregnancy activist. The election in question involved the guy who first hired her into the state government. She is secretive and fails to follow voting laws.

I wouldn't let her count chickens.

3. You all need to see that this supports the idea that the Brookfield votes WAS a mistake

GAB is investigating with a fine-tooth comb. The Kloppenburg campaign is investigating with an even finer tooth comb. And there will be a recount in which every ballot is looked at with human eyeballs.

If this asshole wanted to throw the election to Prosser, this is about the stupidest way she could have done it. Anyone with access to city and county vote totals and a calculator would discover it in 5 minutes once the error was announced.

BUT it MUST and WILL be thoroughly investigated. Incompetence to that degree is as bad as fraud. That woman is responsible for *MY* vote and I want answers and I want a fine-tooth comb to see if she's made other mistakes and/or actually acting nefariously. This alleged mistake has opened her up to a deep deep dive that I am sure she didn't want. If she so much as forgot to cross a "t", we'll find it.

2. Prosser's Home Town Paper Endorsed Kloppenberg due to ARC scandal
The Appleton-Post Crescent rejected sitting Supreme Court Justice David Prosser and endorsed challenger JoAnne Kloppenberg.
Here are some relevant paragraphs from the paper's endorsement editorial:

In 2006, Prosser said that while he was a legislative leader, staffers who worked under his direction did campaign work. He also acknowledged that in his interview with The P-C on March 18.

Here's a member of the highest court in Wisconsin, whose judges are expected to possess unimpeachable integrity, admitting he condoned illegal activity as an elected official.

In a brief filed by the attorney of former state Rep. Scott Jensen, a Prosser protege who was charged with three felony counts of misconduct in office (in a December 2010 plea deal, Jensen pleaded no-contest to a misdemeanor charge), Prosser said he basically did the same thing that caused Jensen to be charged.
