Read the Constitution. Obama needs a declaration of war for it to be legal action. It is Congress not the President who has the authority to make the decision to take the nation to war. On #2 ... he can let them expire. And in 2012, after the reelection, the GOP can't hold tax cuts for the middle class hostage as they did this time.
