NJ woman chides NYC smoker, gets stabbed with pen

NEW YORK – A New Jersey woman was stabbed in the face with a pen on a New York City subway train after she tried to stop a man from lighting a cigarette.

The assault occurred on a crowded No. 3 train near the Chambers Street station during Tuesday's morning rush.

Witnesses told the Daily News and the New York Post that an argument quickly escalated when Evelyn Seeger asked the man not to smoke. The witnesses say two riders were trying to restrain the man when he pulled out a pen and slashed Seeger's face.

Seeger, of Nutley, N.J., was treated at a hospital and released.

1. When I travel in Metro area using mass transit, I really try to remain anonymous and ignore crap

12. i heard that!
when i used to ride public transit, i would do the same, just keep my nose in a book. eye contact was enough to start them up ("what you staring at?"). there are a lot of young punks, unmedicated schizophrenics, drunks, etc. that just hop on without paying (honor system, heh), trying to provoke incidents. the rentacops were useless, as they were only equipped with a walkie talkie and just stood there watching. one time, an older man asked some young men to stop swearing loudly, and the kid just lit into him. not worth it to say anything.

however, one time (i could write a book on this, i swear!) i was on a crowded train when a drunk started making remarks to women, just generally disrespectful. no one said anything to stop him except for one short older guy with balls of steel who told him he would throw him off the train if he didn't shut up, and he literally did that at the next stop! grabbed him by the back of his shirt and pushed him out the door. everyone clapped after he did!

2. Hard for an addict to stop apparently....
And before the nanny staters start chiming in, I'm sure it's illegal to smoke on any form of public transportation in NYC.

...this persons addiction to cigarettes is the main problem. And I'm pretty sure it's illegal to smoke on public transportation ANYWHERE. I'm a smoker and I don't think prohibiting people from smoking on public transportation has anything to do with the nanny state. It's just common sense. If this guy lacked that common sense AND chose to react in such a violent way he probably lacked other faculties and has other issues.

6. Wow. How can owning a pen be considered "criminal possession
of a weapon? I see why he was arrested and charged, but why with that particular "crime"?
