... to keep it and other news outlets from publishing "state secrets"?
I know Nixon lost 9-0 but it's different court and a different era. Seems likely that he could get 4, maybe even 5 votes.
Seems like a logical move, if one truly believes national security issues are involved.
Keep it simple , please.

Obama seems to be okay with arresting whistleblowers and subjecting them to harsh and abusive treatment in in prison prior to any trial.
He probably figures he can do this without any political consequences. So far, it hasn't cost him dearly at a political level.
However, prosecuting the NYT would be a frontal attack on the 1st amendment, and he probably thinks that's not a politically safe, or even politically viable, thing to do.
Clearly, though, this president is not a strong advocate for free speech.
