Conservatives in California, incensed by a U.S. District Judge who overturned the state's ban on same-sex marriage, are claiming in an appeal that the decision should be nullified because the judge is actually a gay man.

U.S. District Judge Vaughn Walker, who overturned the same-sex marriage ban known as Proposition 8, retired from the federal bench at the end of 2010. Walker publicly came out as a gay man to reporters last week, and disclosed that he had been in a relationship with another man for 10 years — the rhetorical ammunition those opposed to same-sex marriage are using for their latest attack.

Walker's sexuality had been an open secret in legal circles for years (he has been in a relationship with a doctor for 10 years), but his public disclosure, Prop. 8 proponents declared, meant that Walker had a "clear and direct stake" in legalizing same-sex marriage.

Walker told reporters last week that he never considered recusing himself from the case, because sexual orientation should never be a basis for a legal decision, the San Jose Mercury News reported.

I'm surprised they aren't calling for impeachment, a recall, tar, feathers, stocks and a public hanging.

5. Here's the response to use...
If conservatives believe that Gay Marriage has any impact at all on heterosexuals, that any heterosexual Judge must also be recused from hearing the case.

And if Gay Marriage doesn't have an impact on heterosexuals, then there's no need to ban it.

There is no depth conservatives won't plumb, no bigotry so offensive, no rhetoric too inflammatory, that they won't use it. And the worst thing is that so many of them don't even realize they're being offensive.

discarding a personally held belief when rending a legal opinion.

Activist judges are a GOP-made reality. Just look at Scalia, Roberts et al.

9. Well , how could they have a hetro judge then?
Wouldn't that skew the decision the other way, just because he's a hetro? By their logic it would. This decision should be read and if the judge is correct in his written decision and what he based it on, then there should be no further questions on his bias or lack of.
