Attorneys say independent autopsy shows Dijon Kizzee was shot 15 times
Attorneys representing the family of Dijon Kizzee said the 29-year-old man sustained 15 gunshot wounds and disputed the Sheriffs Departments assertion that he pointed a gun at deputies before he was shot in South L.A. last month.
At a news conference Tuesday, attorney Carl Douglas said deputies fired some of the shots when Kizzee was already on the ground, and that the gunfire didnt immediately kill him. He said those findings came from an independent autopsy commissioned by the family and displayed a body diagram showing the entry point of each wound.
What this shows is he was alive and breathing and writhing in pain when the officers continued to stay away, Douglas said, suggesting that deputies did not render aid during those critical moments as Kizzee bled to death on Aug. 31. Kizzees family members stood by, wearing black face masks that said, Justice for Dijon Kizzee.
The shooting occurred in the 1200 block of West 109th Place in the Westmont neighborhood after the deputies alleged that Kizzee was riding his bicycle in violation of vehicle codes. The Times has identified the two deputies as a trainee and his supervisor.

It seems like a discrepancy whether or not he had a gun.

(26,793 posts)And it was a gun that was not legal in the state (15 rounds) and not legal for him to possess (both felony record and an active restraining order)
The question was whether his actions rose to the level necessitating deadly force (maybe) and whether the continued use (18 shots?) when he was down and no longer a threat was justified (cant see how). Also whether there were ways for officers to handle it that would not have escalated to the point of conflict in the first place (almost certainly)

(26,793 posts)The video is consistent with that part of the story... and the gun in evidence couldn't have been planted afterward because investigators found photos on his phone of him with the gun (including an identifiable serial number apparently).
Just as persuasive - nobody disputes that he had the gun. An eyewitness said his hands were empty when he was shot and the family attorney disputes claims that he had picked it up or was reaching for it when shot... but they don't dispute that he had a gun.

(26,793 posts)Murder would involve the previous intent to kill him. That's tough to say. The shooting appears justified right up until the first couple shots are fired. BUT the description includes the officers firing three groups of shots:
The first handful could be justified. The "barrage of a dozen" after the gun is now out of his hands and down the sidewalk is at least excessive force. The third "few deliberate ones" must be after he's down and clearly no longer a threat. I can't see an explanation for that. If there's reason to believe that he would have survived the first few shots (not sure whether that could be established or not), that could be murder.
But no question that he had a gun. No question that he should have been arrested and locked up. Just the simple point that this doesn't justify his death.

What there any reason to pull him over other than he was Black? ... No.
If he was White, would he be alive right now? ... Of course, because the police would have never pulled him over.
But knowing that won't bring him back.

(And occasionally unarmed white people, like that 13-year-old autistic boy in Utah, but still the pattern holds)
Meanwhile, Dylann Roof and Kyle Rittenhouse definitely had guns and definitely shot people, and the police seem to have managed to take them in alive. Huh, wonder what's different about them? What about all those white neo-nazi guys wandering around the protests with assault weapons proudly displayed? Wonder why the cops don't feel compelled to shoot THEM?
This sounds like victim blaming.

So what if he was riding his bicycle the wrong way and had an unlicensed gun? Neither of those things are death-penalty crimes. The whole reason we have a justice system is so that people can be arrested, tried, and sentenced by a jury of their peers in a court of law. Cops who kill a non-violent defendant rather than bringing them in have failed at their jobs. Period. And we KNOW that they are much more eager to do so, unrepentantly, and even brag and laugh about it later when their murder victims (YES I SAID MURDER VICTIMS) are Black.

The bottom line is if he didn't have a gun he would be alive right now.
I'm not defending the police, nor am I evening trying to, but there is no way you will convince me that someone carrying an illegal firearm is a good person anymore than you will convince me that Kyle Rittenhouse is a good person.
I'm not gonna feel sorry for someone walking the streets with illegal firearms ... not a chance.

And he could've been fearful of the cops knowing they hunt men of color, and been acting in self defense.
