Kenosha County Judge Bruce Schroeder asked the jury to leave the room while he and the attorneys talked over the prosecutions objection to specific portions of video analysis from John Black, the defense's witness, on Thursday, saying it was outside the courts order.
It certainly was my impression that we were talking about video of the entire episode and ... certainly in my mind is not limited to the specific numbers on this observation point list that you're talking about, Schroeder said to Kenosha County Assistant District Attorney Thomas Binger.
I am a little bit challenged when you say is there something that I'm saying that draws the face that you're making?
I have to say, your honor, yesterday, I was the target of your ire for disregarding your orders. Today the defense is disregarding your order, Binger replied.
Yesterdays heated exchange between the judge and Binger came up again a few minutes later with the prosecutor saying, yesterday, as I said, I was under the courts ire and Schroeder cutting him off saying, you know, I dont want to talk about it.
I think it's a fundamental fairness issue, your honor, if I'm being held to obey the court's orders, I'm asking that the defense be held to that too, Binger persisted.

(155 posts)The Judge's cell phone went off in the court room, itself unprofessional, and it was playing Trump's theme song. Also, he made some racist ant-Asian comment regarding Asian food. So, not sure why this Judge has not been removed. The prosecution needs to file a mistrial in this case.

Apparently, the prosecution has made some mistakes, but this guy is toxic.

Personally, I'd like to understand the legal challenges this case faces rather than blindly hoping for the best. I expect him to walk and hope that I'm wrong.

Just people who value facts over blind emotion. Many seem to want to dismiss key pieces of evidence because it doesn't fit their chosen narrative of the case.

I'm no lawyer but getting to mistrial status might not have to depend on a hung jury.

(21,813 posts)It does not have to be a hung jury. And, so long as the defendant has not been acquitted or convicted yet, a mistrial can lead to a retrial. An NPR news report on this trial this morning questioned why the defense requested a mistrial since it .would give the prosecution a chance to appeal and retry the case, with a different judge.

(21,813 posts)it's the prosecution on the basis of the judge's obvious bias. I'm not sure how that would be done. Seems the prosecutor would need to file a request or complaint with another judge or court. I'm not a lawyer so I don't know what the procedure would be. Maybe one of our DU legal experts could explain it to us.

I really just want this to end. It's sucking the life outta me.
This pasty, pudgy kid thought he could trek up to WI and get some cool pics to post on social media. Maybe THEN that girl would pay attention to him! Maybe THEN those bullies would stop pushing him around. He's a little loser that thought he could play grownup games and panicked after it became all to damned clear that he was way out of his element.
Little shit needs to suffer some type of punishment, but what he gets won't be nearly what he deserves.

If you'd like a dissertation on how his physical appearance could be a background cause for his need to act like a tough guy...I don't have the time. He's a baby-faced (pudgy), pasty (doughy) little shit. Probably with very low self-esteem. This could be a major factor in why he thought playing cop would be a great way to improve his cred with his peers.

(51,403 posts)is other attorneys have made a point of getting a judge other than Schroeder for this case. And that apparently has put more of a load on other judges in the county.
That should indicate a problem with the judge.
