The fact that the NFTs appear to use existing images doesnt mean an actionable copyright infringement has occurred. For example, do we know whether the creators of the images registered them with the Copyright Office (a prerequisite for bringing an infringement action)? Did the creators of the NFTs license the images from their originators? Finally, even if the images are infringing, would Trump himself be liable for the use of the imagery by the creators of the NFT images?

(1,766 posts)To have the copyrights registered at the time of the theft--only before filing the suit. So if someone with an unregistered image sees that someone has ripped off said image, all they have to do is go to a lawyer, who will file the registration. The second after that gets done, the lawyer can then sue for copyright infringement.
So it doesn't matter if it was registered when it was stolen. It only matters if the legit owner has registered for copyright on the work when the suit gets filed.
It's only been a few days since this idiot scheme came to light. Let's give the legit owners a chance to find out their work has been stolen, contact attorneys, register copyright, file suit and all of that. It won't happen overnight.
And I can bet at least one of them will do just that.
