SC: Circuit Court judge denies request to enforce abortion bill at 9 weeks
COLUMBIA, S.C. (WIS) - Circuit Court Judge Daniel Coble has denied a preliminary injunction request from Planned Parenthood for the state to enforce the “Fetal Heartbeat Law” at nine weeks instead of six.
The court ruled that it was “clear beyond a shadow of a doubt that the General Assembly intended, and the public understood, that the time frame of the Act would begin around the six-week mark.”
In 2021, the South Carolina General Assembly passed the Fetal Heartbeat and Protection from Abortion Act. However, the act was struck down as unconstitutional in January and a new version of the Fetal Heartbeat and Protection from Abortion Act was passed after the ruling.
Planned Parenthood said in court papers that in the first five months of the new law, three-quarters of women seeking abortions were turned away because their pregnancies were too far along, and 86% of those three-quarters could have had the procedure if the law allowed abortions up to nine weeks.
