(707 posts)If I have a hidden camera on me and film you in Oklahoma it is perfectly legal because I know we are being recorded. In some states both people have to agree to be recorded or it is a violation of wiretapping laws. Each state is different but here is a twist it's only for audio that it would be illegal video without sound is always legal if you are in a public place.

For audio, California is a two-party consent state. But since it occurred in a crowded restaurant, no consent is needed, as there is no expectation of privacy.
At any rate, as the video isn't going to court, it doesn't matter. Surely its bad manners, but they have every right to go to the media with it.
