Didn't Gulliani prosecute Leona Helmsley for the same tax practices he excuses for Trump?

I was watching his interview with Barbara Walters. He specifically mentioned that the Helmsleys were claiming personal expenses as work expenses, and that was one of the things they were prosecuted for doing.

I'm not very tax or finance savvy, but how is that any different from some of the stuff Trump has done. Specifically his buying that big portrait for his club by using funds from the "Trump Foundation"? Yet Gulliani seems absolutely fine with what Trump has done.
