Liberty Council Wants Sanctuary Cities Where Gay Marriage Can’t 'Hurt Them'

Mat Staver, a lawyer with the rightwing Liberty Counsel, encouraged local governments to stand up and resist the Supreme Courts decisions on abortions and marriage equality.
We have an independent duty to also interpret the same Constitution that they do, and theres nothing in there about a Constitutional right to same-sex marriage, so in our state, I think what they ought to do is still say marriage is between a man and a woman, and were not going to recognize anything else. You know what, if some cities can create sanctuary cities for illegal aliens, why cant a city or a state create a sanctuary city or state to protect the preborn? Host Jim Schneider added, And to protect marriage. And wouldnt you know it, Staver agreed: And to protect marriage, absolutely.
Staver then gave the example of one of his Kim Davis, a clerk in Rowan County, Kentucky, who is being forced against her will to do her job, which is issuing marriage licenses. She needs a sanctuary city to live in where she wont have to do her job at all, because when a clerk issues a license for anything, it puts that clerks stamp of moral approval on that thing:
They provide a license to do something. They provide a license that gives you the legal authority to drive a car. They provide a license that gives you a legal authority to operate a business. So theyre providing a license that gives you a legal authority to do what? To engage in a sinful activity with a sinful relationship, a same-sex so-called marriage.

(301 posts)Equal protection is a constitutional right and, effectively, a mandate on the states to treat people the same way. States can't pick and choose here.
Conversely, there is no constitutional requirement (much less any kind of civil right) that says state and local law enforcement have to proactively enforce federal statutory law like immigration. I'm sure these folks have lawyers from Liberty U to explain the distinction. If they cared to listen of course...
