Suit revived against Christie allies over GWB lane closings

A class action lawsuit against several former officials from the Christie administration and the Port Authority was revived on Thursday seeking damages for drivers caught in the George Washington Bridge lane closures.

A previous lawsuit in the civil case was dismissed by a federal judge in June because it didn’t have enough information about the actions of specific defendants named in the suit. On Thursday, lawyers representing a group of drivers and taxi companies that were stuck in the traffic tie-ups that lasted five days in September 2013 filed a revised 87-page lawsuit that relies heavily on information that emerged from a federal indictment of two former Christie allies and a legislative investigation into the closures.

The civil lawsuit names David Wildstein, a former Port Authority executive who pleaded guilty to federal charges in May, and two others who have pleaded not guilty in the criminal case: former Port Authority deputy executive director Bill Baroni and Christie’s former deputy chief of staff, Bridget Anne Kelly. Their trial is scheduled to begin in November. Also named as defendants are Christie’s former spokesman, Michael Drewniak; the Port Authority; the state of New Jersey, and Christie’s gubernatorial reelection campaign group.

The suit accuses the group of racketeering, consumer fraud and violations of state and federal constitutional rights.

A nervy lawyer might argue that they were acting in their official capacity. "This is how we roll in New Jersey". The lawyer might not have to get specific, he might just be able to argue that the burden of proof that they weren't acting on behalf of their boss is on those doing the suing.

IANAL squared but how do you convince a jury that Christie is innocent and that his administration/New Jersey shouldn't be paying any damages? Wouldn't that be the reasonable assumption, that they were following their bosses wishes?

Huh, depending on how things look I wonder what they could get away with testifying in that vein without admitting anything seriously criminal.


But I am not a lawyer, so I hope one will explain this case.
