AG: Bevin's university budget cuts are illegal

FRANKFORT, Ky. Kentucky Attorney General Andy Beshear said Friday that Gov. Matt Bevin did not have legal authority to order the mid-year budget cuts he imposed on state universities Thursday.
If Bevin does not withdraw the cuts in seven days, Beshear said he'll file suit to have the courts overturn the cuts.
Unless there is a declared state revenue shortfall, a governor cannot unilaterally cut appropriations made in the state budget by the General Assembly, Beshear said.
He said Bevin's cuts violate state law governing budget reductions, the current budget passed by the General Assembly, and the separation of powers clause in the Kentucky Constitution.

(251 posts)Immediate 4.5% to ALL state universities and community colleges, with 9% cuts the following two years after (and no promises on funding after that). This is in Kentucky where we are so far behind every state that we competed with Mississippi for 50th place for title of least educated state! Sure you have Louisville and Lexington which aren't bad and are pretty good despite the rest of the state, but other places in this state live in moronsville or religion hell. We have the god damn fucking Ark Park supported with state venture money and Creation museum that is just sad. So Ky has a short fall in our teachers pension fund that has been with the legislature for years that can be solved by purchasing low yield bonds and put the interest towards the pension fund, like every other state does. But Noooo... Our gov Bevin wants to train wreck our economy and any hope of Ky NOT being a laughing stock in education.

(1,701 posts)But if it makes you feel any better, my state, Oregon, which is supposed to be one of the most progressive states in the country, has underfunded education for years. There has been a disinvestment in education nationally by both state governments and the federal government ever since the end of the Cold War, as tax revenues--thanks to the federal tax code that favors the wealthy--has not kept up with the spending needed for all sorts of societal goods, such as education and infrastructure. This has to change, and it is why I support Bernie for president (well, that and global warming, which he takes seriously).
