'Enough really is enough': Kari Lake's attorneys hit with sanctions filing day after Christmas

Prior to Judge Peter Thompson's ruling against Lake's effort to overturn the 2022 election for governor, Maricopa County Attorney Tom Liddy informed the court that the defendants would be asking to sanction opposing counsel.

Thompson ordered defendants to file sanctions documents with the court by 8 a.m. on Dec. 26. The Maricopa County Superior Court website confirmed on Monday that the motion for sanctions had been filed.

Attorneys for Lake have until 5 p.m. on Monday to respond to the request for sanctions. The defendants have also asked Lake to pay attorney fees.

As usual, I'm not holding my breath. Probably just a slap on the wrist.

Seems like these lawyers who handle frivolous cases seldom get held accountable. It's a nice thought to think that they will be, but never seems to happen.

“A Historic and Profound Abuse of the Judicial Process”

Full of indignation and spanning 110 pages, U.S. District Judge Linda Parker‘s ruling reads like a treatise on the judiciary’s role in protecting the democratic process.

“This lawsuit represents a historic and profound abuse of the judicial process,” Judge Parker wrote in her opinion and order. “It is one thing to take on the charge of vindicating rights associated with an allegedly fraudulent election. It is another to take on the charge of deceiving a federal court and the American people into believing that rights were infringed, without regard to whether any laws or rights were in fact violated. This is what happened here.”

More than half a year ago on Dec. 7, Judge Parker decisively rejected Powell and Wood’s effort to overturn President Joe Biden’s victory in Michigan in a scathing, 36-page ruling. “Plaintiffs ask this court to ignore the orderly statutory scheme established to challenge elections and to ignore the will of millions of voters,” Parker wrote. “This, the Court cannot, and will not, do.” “The People have spoken,” she added.

The self-styled “Kraken” attorneys behind a series of outlandish federal lawsuits seeking to overturn 2020 election results in four U.S. states urged a federal appeals court to overturn a sanctions order that earned every member of their legal team referrals for possible disbarment. A little more than a year has passed since a federal judge issued blistering sanctions against nine attorneys led by attorney Sidney Powell, who told the Jan. 6th Committee that former President Donald Trump wanted to make her special counsel for voter fraud.

“Extremely Dedicated and Hard-Working Lawyers”

As found by U.S. District Judge Linda Parker in August 2021, the case that Powell and her co-counsel filed in a federal court in Michigan “was never about fraud.” “This lawsuit represents a historic and profound abuse of the judicial process,” Parker wrote in a massive 110-page opinion and order. “It is one thing to take on the charge of vindicating rights associated with an allegedly fraudulent election. It is another to take on the charge of deceiving a federal court and the American people into believing that rights were infringed, without regard to whether any laws or rights were in fact violated. This is what happened here.”

On Thursday afternoon, Powell expressed no regrets for how she undertook the litigation. “We were a small group of extremely dedicated and hard-working lawyers who filed a complaint,” Powell told the three-judge panel. Powell’s co-counsel included highly visible figures in Trump’s orbit, including attorney Lin Wood, who was photographed with the former president in early 2020, and Juli Haller, a former member of Trump’s Department of Homeland Security. The other six lawyers on the legal team were Emily Newman, Brandon Johnson, Howard Kleinhendler, Scott Hagerstrom, Gregory Rohl, and Stefanie Lynn Junttila.

“I don’t know what more we could have possibly done to comply with Rule 11,” Powell said, referring to the rule forbidding lawyers from filing cases for “improper” purposes. One of the judges noted that another affidavit filed by Russell James Ramsland Jr. was facially “ridiculous.” She did, however, own up to what she described as “mistakes,” including not knowing enough about the person behind an affidavit that she code-named “Spyder.” Her legal team identified him as a “military intelligence expert.” The Washington Post unmasked him as Joshua Merritt, who was an Army mechanic who was not in intelligence.

With the above type of sanctions (and we have been seeing this play out with Ghouliani) it takes awhile to get through the administrative process. Ghouliani was already suspended from practicing in NY -

and his disciplinary hearing for D.C. happened the first 2 weeks of this month ending with a recommendation for him to be disbarred. A court decision is due by sometime in March.

Arizona’s Governor-elect Katie Hobbs (D) asked a judge on Monday to sanction defeated rival Kari Lake (R) and her lawyers for filing a lawsuit aiming to overturn the results of the Grand Canyon State’s 2022 gubernatorial midterms.

“Courts are established by Arizona’s Constitution and statutes to resolve actual disputes between parties,” Maricopa County Deputy Attorney Thomas P. Liddy wrote in a 15-page memo. “They do not exist so that candidates for political office can attempt to make political statements and fundraise. And they should not be used to harass political opponents and sow completely unfounded doubts about the integrity of elections. All of those things happened in this matter.”

Hobbs’s legal team joined Maricopa County’s motion for sanctions, court records show.

“Enough really is enough. It is past time to end unfounded attacks on elections and unwarranted accusations against elections officials,” the memo states. “This matter was brought without any legitimate justification, let alone a substantial one.”

I'm glad they hit the lawyers, who should know better even if she's a delusional mess. She gets hit with enough court costs and attorney fees, maybe she'll change tactics and just find RWNJ microphones to whine into.

The one thing she'll never do is seek the help she obviously needs.

... but explains that this amount is conservative since they only had xmass eve and day to complete the filing. They suggest that if the court allows an amended filing they can submit a more accurate (and larger) amount.

As long as she has the pillow guy paying her legal fees, this nonsense will never end. The skeevy lawyers won't tell her where to go, so the federal judges must do that.
