Donald Trump argues in wild court filing that New York can't sue the Trump Organization because it doesn't legally exist
Donald Trump, his real-estate company and his three eldest children have filed an extraordinary, nose-thumbing response to the $250 million fraud lawsuit filed by New York Attorney General Letitia James in September, stating that "Trump Organization" is branding shorthand not a legal entity so it can't be sued.
"To the extent a response is required, Defendant specifically denies the definitions of "Trump Organization" and "Defendants," reads Donald Trump's response to the lawsuit, one of 16 answers filed late Thursday night.
"While the shorthand "Trump Organization" is utilized by Defendants for branding and business purposes, no entity as such exists for legal purposes," Donald Trump's response continues, using language that is repeated throughout his 300-page filing and throughout the similarly-lengthy 15 filings of his fellow defendants.

(38,454 posts)I won't say that I'm 100% confident about that, but I will say that my recollection is that he filed the new company after she filed suit and then she immediately asked the court for someone to oversee his transactions so that he couldn't transfer his assets to the new company.
If I'm wrong about that, or I have misunderstood the situation in some way, I apologize.

Good luck with that argument. Look for Trump to get hit up for big legal fees for
filing a junk lawsuit. N.Y.'s A.G. James will cram this lawsuit up Trump's ass, make
it very costly for him, and have it thrown out of court in a heartbeat.

(4,339 posts)defense of reasonable(?) disambiguation, which it is not--rather for the fraudulent purpose, in time (which is a term not thoroughly defined of its properties), not to ever be held accountable, sort of an inside-out Kenny Lay defense - i.e., still breathing--no crime vs. not breathing--one may have an opinion and speak it, though that will forever keep the ambiguity alive and well.
This case needs to be thrown out and adjudicated with a steep monetary penalty for wasting the court's resources.

The combination of malignant narcissism and antisocial personality disorder makes him utterly shameless and unafraid to go out on the flimsiest limbs imaginable. The fact that this often works for him doesn't make it admirable.
What bothers me the most is that there always seem to be lawyers who are willing to indulge him in filing these ridiculous suits. To me, that's the most mind-blowing part of it.
Justice matters.

And they're not failing him yet. Oh sure, he loses a few rulings, pays fines etc. But he's still living in luxury, living off his property wealth, golf courses, and other investments. Protected on both ends of the coin from ultra wealthy elites with fascist leanings, and dumb as bricks cult followers. As well as a whole propaganda TV news network with the largest audience in the US, as well as domination of local talk radio across the country, all of which will always back him. Or at worst, ignore his crimes, while exaggerating and lying about his "enemies" actions.
Delay delay delay delay....along with maybe finding a couple more "Trump judges" along the way, together with a weak AG, and its.....Donald Trump elected the 47th President of the united States of America!

And so you sue every party in sight to make sure those responsible don't get away.
In this particular lawsuit, a whole bunch of Trump companies and personnel are named - including "Trump Organization Inc"
In the wake of their criminal findings, Trump and family pleading the 5th hundreds and hundreds of times and Trump dropping a second lawsuit against James earlier this week,

To be clear, not commenting on the merits (or lack thereof ) of any of the factual or legal assertions in the response.

(7,182 posts)In order to have a limited liability, a person needs to form an entity/organization separate from the person - so they form a corporation, limited liability company or limited partnership. If the person holds themselves as a type of organization/entity but do not actually form an organization/entity, they are basically operating as a dba of the individual - which makes the individual individually liability. There is no corporate or LLC "shield" to protect the individual from liability.
The "Trump Organization" does not appear to be filed in NY as a dba of a legal entity. That would suggest it is a dba of the individual - Trump.

Trump's lawyers are not contending that the "Trump Organization" doesn't exist as a legal entity, which is correct. It is merely a shorthand for a collection of related legal entities. Trump's argument is that by lumping all of these entities together as if they were one entity, the complaint fails to provide adequate notice as to what conduct is being attributed to particular entities.
However, that argument won't hold water with the court. Using a shorthand to refer to a group of related entities is SOP.
