Prosecutors in former President Donald Trump's Manhattan criminal case have released to his attorneys a recording of Trump and a witness, whose identity was not disclosed, according to a document the office made public Friday.
The document, called an automatic discovery form, describes the nature of the charges against a defendant and a broad overview of the evidence that prosecutors will present at Trump's preliminary hearing or at trial. Trump's attorneys and media organizations, including CBS News, had repeatedly requested that such a form be made public in the weeks since Trump's arrest on April 4.
Trump is the first former president in American history to face criminal charges. He has entered a not guilty plea to 34 felony counts of falsification of business records for alleged payments made as part of a "hush money" scheme. The document lists the dates of 34 instances between Feb. 14, 2017 and Dec. 5, 2017 when he allegedly falsified records.
In a section devoted to electronic evidence that will be turned over, a prosecutor for Manhattan District Attorney Alvin Bragg's office indicated they have disclosed to the defense a "recording of a conversation between defendant and a witness."

When Cohen was under investigation, they took everything he had "electronic" and had to appoint the "Special Master" to separate out "attorney-client" stuff from the rest.

Washington CNN The FBI raided the office of Michael Cohen, a personal lawyer and confidant of President Donald Trump, Cohens attorney confirmed to CNN Monday. One source familiar with the matter told CNN that included in the documents authorities seized was information related to Stephanie Clifford, better known as porn actress Stormy Daniels, who alleges she had an affair with Trump in 2006 that the White House has denied.
A source familiar with the matter said the search warrant was very broad in terms of items sought, and another source said the search included bank records. Stephen Ryan, a lawyer for Cohen, said in a statement that the US Attorneys office for the Southern District of New York had executed a series of search warrants including at his office, and seized the privileged communications between Cohen and his clients.
Trump slammed the move Monday as a disgraceful situation and an attack on our country. A White House official said Trump had been watching TV reports, and that the President knew about the raid before the news broke.
The Monday raids included the Loews Regency hotel where Cohen has been staying, according to a source familiar with the matter. There were approximately a dozen FBI agents involved, the source said. Additionally, The Wall Street Journal reported the raid included Cohens home.

Senator Daines and Representative Rosendale were both set to support the coup attempt with votes not to certify the results of the election.Daines lost his nerve after the insurrection failed, but I would guarantee that they were both read in on the plot. To date, no one has asked them, let alone under oath. Every member of Congress should have to go under oath and answer whether or not they had any advance knowledge of the fake electors plot and the January 6th insurrection.
Again, I dont know of any way to actually do it, but it should be done.
Justice matters.

Prosecutors rarely ask questions they don't know the thrutful answers to before they ask them, and for that, they must have access to damning pieces of evidence first.

(151,979 posts)The feds had all of his "electronics" (laptops, phones, etc) from the "earlier version" of this case filed in federal court for federal charges and I recall Cohen mentioned this during some of his recent appearances on MSNBC in relation to the NY state case.

I admit this is overmuch but I'd love to have some of my past interactions with "others" recorded for a "he said, she said" record.
I'm also guessing that in these days of video recording much of our lives, this will become standard. Perhaps it will be required by law: "Why wasn't your government-issued recorder functioning when you ran the stop light?"
