Problems pile up for Righthaven with new ruling (in favor of DU)

Source: Vegas Inc (Las Vegas Sun)

Legal problems are snowballing for Las Vegas copyright lawsuit filer Righthaven LLC, with a judge on Wednesday entering yet another judgment against the firm.

In Righthaven’s 2010 lawsuit against the Democratic Underground political website, U.S. District Judge Roger Hunt in Las Vegas granted a motion by the Democratic Underground that final judgment be entered against Righthaven.

... Significantly, Hunt found Wednesday that his ruling from June dismissing Righthaven from its own lawsuit for lack of standing “was a dismissal on the merits” and Righthaven’s dismissal from the suit was with prejudice.

... The language in Hunt’s order Wednesday means the Democratic Underground can petition the court for an award of its attorney’s fees, which are likely to run into the hundreds of thousands of dollars, given that the case was extensively litigated.

when they find out that the judge that issued the ruling is a Clinton appointee and a Mormon!

Since the whole thing was predicated on a fraud, would they be able to try to get their settlement reversed? How many freepathons will they have to hold to raise the cash to try to get back their cash?

And Righthaven, I'd like to be gracious.

But I can't.

Don't expect a check any time soon. Righthaven has lost just about all their assets, their business model collapsed, and they have about zero chance of future income.

They thought small sites would not have the ability to defend themselves, but apparently they found out that even small sites can have some very powerful entities supporting them behind the scenes.

Surely in fact, political speech should be one of the MOST protected kinds of speech, it would seen.

THough if you get into trouble? A "Democratic Underground" vs. "Right Haven" case, would perfectly frame the matter, for the US Supreme Court. With a name almost as good as the eponymously-named "Roe" vs. Wade case.
