(San Francisco sheriff) Mirkarimi asks court to give him his job back

Ross Mirkarimi, who was suspended as sheriff without pay a week ago, petitioned the court Tuesday to reinstate him - the latest twist in a political and legal saga that began more than two months ago.

Mayor Ed Lee charged Mirkarimi with official misconduct last week. His decision was prompted by Mirkarimi's March 12 plea agreement when he pleaded guilty to misdemeanor false imprisonment of his wife during an argument New Year's Eve.

The mayor wants to strip the job from Mirkarimi permanently.

"Mayor Lee's suspension of Ross Mirkarimi violates the law in several respects, and we are asking the court to intervene and reinstate him," said Mirkarimi's attorney, David Waggoner.

He was elected by the voters. There's no provision to remove him for what he did under the circumstances. If someone doesn't like it, they need to change the law.
