Will it matter that Sanders is popular with the voters, and still very much in the running? Political considerations won't be totally discarded, imo, if the DOJ has decided to indict people, and only must consider high up that will go.
If Sanders is out of the race, then taking an indictment against the only one running for our nomination would mean the Democratic party would get crushed at the polls.
If Sanders isn't out of the race, and is instead running strong, a whole different political calculus comes into play.
Imo, this scenario, while based on hypotheticals, is very much on some people's mind, and is goading them on.
P.S. This isn't about fairness, but about how things might play out. The FBI may very well just vent its disgust at what went on, but conclude it's not worth pursuing prosecutions. That may or may not be fair, but it's how it may play out. Among the many other possibilities is that they might conclude that they aren't going to just shrug off any "everybody does it" violations of the regulations.

I think the DOJ knows that a judgement call, of one kind or another, is quite possible.

One reassuring factor is that FBI Director Comey is a straight shooter.
But we may find out if Obama is willing to put his thumb on the scale of justice for Hillary.

He does have a legacy he wants to keep. Having his SOS even get indicted is one more notch against him as well.
