…are based on the utter fallacy that there is some high opportunity cost to “worrying” that leads to doing less.

Just admit there’s good reason for people to be angry and criticize the DoJ and criticize our legal system and stop dodging that you have been, in fact, defending the indefensible, and drop the phony false dilemmas.
