The Supreme Court appeared poised to reject Donald Trump’s sweeping claim that he is immune from prosecution on charges of trying to subvert the 2020 election, but in a way that is likely to significantly delay his stalled federal trial in D.C.


“I don’t understand how the clear statement analysis even works, it seems completely tautological to me for us to hold that presidents cannot be prosecuted under any criminal statute without a clear statement from Congress.”


Thursday’s argument suggests Chief Justice John G. Roberts Jr. will be in a familiar role — the swing vote in a 5-4 decision.


A recurring theme throughout Thursday’s argument: The conservative justices are not interested in getting into the specifics of the case against former president — and likely 2024 GOP nominee — Donald Trump.


They don't want to agree with Trump's claim for absolute immunity but they want to make sure what he is accused of is outside a President's official duties...
