4. There are 12 justices on the circuit Court of Appeals

three of whom will be chosen by lottery to decide whether the whole court should hear the case. The last time around the vote was 10-2 not to hear it. The Schindlers' only hope is that the two judges who voted to hear it the first time are somehow in the initial three-judge panel.

I'm not sure what those odds are, but they're pretty long.
