3. they forgot about it.
they thought controlling the executive & legislative branches would be all they needed. Then those damn 'old school' conservative 'activists' judges continued 2 uphold the Constitution AND rule as UNconstitutional some of the very 'laws' their executive branch pushed and their legislative branch passed. They're now pissed cuz they thought they controlled the judiciary. They R now seeking to rid themselves of the old school conservatives and replace them w/ neo-con fascist judges. Look @ yellow rogue's nominations - totally outside the judicial mainstream.

And the Constitution is a nurturing document. They only respond to strict father laws - which is why they LOVE punishment - i.e. 'patriot act'; anti-choice position etc..
