The ranchers should have detained the two, then turned them over to Border Patrol for reprocessing out of the country. Instead, they pistol-whipped them and threatened them with firearms - then they LET THEM GO!!! The only disincentive here is a disincentive to beat illegal immigrants: you harm illegal immigrants in way that goes beyond restraint and legal processing, and you are civilly lible. Period. And if future ranchers capture illegal immigrants and DON'T let them go, and DON'T alert the Border Patrol, then they should be criminally liable for kidnapping and murder, and the families of the victims should be able to sue their ass off for wrongful death in American civil court, and should get their land if it's the only asset.
