20. I think you guys are forgetting something
Before any administration can be tried for war crimes, the nation must either voluntarily submit the defendants, or must be conquered by foreign powers. This precedent is fairly well established and was even privately acknowledged by the judges at Nurnberg. One example of this would be the Katyn massacre, which was included in the indictment against the Nazi high command, until it was established that a Soviet force was in fact responsible. Of course, the Soviet Union was a sovereign nation, one of the victorious Allies. Thus, the guilty party could never be charged for the murder of hundreds of innocent people in Katyn. This is how international law works.
