Throughout the interview, he often indicated, in a lawyerly, subdued manner, that things look bleak for the Bushies. He is a good Dem, and as a very prominent lawyer, he should not, and does not, when speaking about legal matters, make rash statements. Most attorneys who wish to keep a good reputation within the profession , speak in an understated way about cases that have not come to a conclusion.

In other words, he spoke negatively of the Bushies' prospects, but he did not spout off about the subject. That is how it should be.
