I already explained how the Bill of Rights is intact in my previous post.

As for the writ of habeas corpus, you still have the right to a speedy trial and can't be imprisoned for more than 48 hours without a hearing. BTW the writ of habeas corpus only applies to citizens, not enemy combatants that our forces picked up in Khandahar.

FDR's administration had to deal with that question when they picked up Nazis that had tried to enter the country back during war with the intent of blowing up things and causing general mayhem.
