9. Concession is not legally binding in any way
The president is elected by the electoral college. It is not Kerry's to concede if he, in fact, turns out to have the majority of EV's. In fact, almost all of the states counts are "unofficial" if you look at their websites. Bush only won New Mexico by less than 10K votes. Have they finished counting all their absentee and provisional ballots? What about Florida and Nevada? Those were close percentage wise as well.
