The feds and supreme court have not given this class protection to sexual orientation, although some states do offer this protection. I do not know the holdings of CA state law or the CA state constitution, so there may be some arguments there. But the law does not see race and sexual orientation as the same period. I know a lot of people bring up Loving, but read the case and prior/subsequent race based supreme court cases. There are different standards (some with a higher burden, some with less) depending on what class is involved in the statutory discrimination.
