25. They were able to do that because there was a Surplus thanks to Clinton!
At the time the tax cuts would not affect the Surplus, hence they were able to use reconciliation and had Cheney's vote to break the tie. Reminder, even McCain voted against the tax cut because he thought it was wrong to do it during a time of war.

Because there is no longer a Surplus, the Democrats cannot pass anything that can't be paid for.

ALSO during this time the Republicans were threatening to use the NUCLEAR OPTION to break and end the filibusters the Democrats were using to stop the giveaways to the rich.
