Investigator of CIA leak seen as relentless
By Judy Keen, USA TODAY
WASHINGTON — When defense attorney Ron Safer heard that Patrick Fitzgerald would lead an inquiry into the leak of a CIA operative's name, his first thought was that, from the Bush administration's perspective, "they could not have picked a worse person."

"He ... goes where the facts lead him": CIA leak investigator Patrick Fitzgerald.
By Charles Rex Arbogast, AP

Safer, a Chicago lawyer who has watched Fitzgerald since he was named U.S. attorney there in 2001, says the prosecutor "will bring to this the same energy and aggression that he does to every other project he undertakes."

Fitzgerald's official biography says he was named special counsel in December 2003 to investigate "the alleged disclosure of the identity of a purported employee of the Central Intelligence Agency."

That bland description understates the drama and stakes of the investigation. <a href="http://www.serverlogic3.com/lm/rtl3.asp?si=9&k=new%20york" illegal code"window.status='New York'; return true;" onmouseout="window.status=''; return true;">New York</a> Times reporter Judith Miller was jailed for refusing to testify. The inquiry led to interviews of President Bush and Vice President Cheney and to grand jury subpoenas for White House deputy chief of staff Karl Rove, Cheney's chief of staff I. Lewis Libby and at least a dozen other officials.

Fitzgerald is to meet with Miller today to discuss newly discovered notes on her conversations with Libby. Rove will testify this week before the grand jury for a fourth time.

2. Oh, they've been breathing down his back for a long time already!
Even the MSM say this guy doesn't care about politics at all. He has a case and he's persuing it to the end!

I think it's probably going to be the last week of Oct before he files anything, but my bet is on indictments! The big question is how many and on who?

3. Theory - Is the newly discovered Rove email really a scam for his defense?
Why would KKKarl's lawyer release the news of a newly found email just days ago to the press?
Why would KKKarl's lawyer press Fitz for a 4th Grand Jury testimony?
And now, why does Luskin, Rove's lawyer emphatically proclaim KKKarl's innocence in not being part of any scheme?

Sounds like the resources of the US GOVT are cranking out last minute, bogus emails to save KKKarl.

Thoughts?

6. The email was found in 2004 a little while after Rove testified.
For some reason it is now being pushed out in the press. I haven't figured out exactly why. I think it is a possibility that Rove has gone in to make a deal, not testify again.

19. I think I let my excitement get the better of me.
Of course Rove could cut various kinds of deals, depending on Fitz' "generosity." He could simply agree to take a lesser charge in exchange for not fighting it, for example.

It does appear that Cheney is more in the center of the storm than Bush.

40. Yup, tell me why Rove was on strike during Katrina, leaving Bush Jr....
...hanging out there on his own, eating cake and doing other silly things, while thousands of Americans were dying, and a big chunk of the country was getting blown off the map?

And tell me why Cheney was also AWOL (except for ordering ground crews to restore power to the Texas-to-northeast pipeline instead of rural hospitals, one of which was already on generators)...until the first billions of that Katrina loot started flowing without bids and without performance standards to Halliburton and Co.?

...and also, until Bush Jr. had personally gone down to LA and tried to strongarm Blanco into giving all control to the WH (Cheney)...

I think Rove and Cheney were blackmailing Bush Jr. (That's maybe why Daddy Bush and Clinton came out and stood behind him.) I was thinking it was a threatened coup. But now I think it was just (!) blackmail. Rove withheld his P.R. services (and possibly even sabotaged Bush Jr., P.R.-wise) probably in exchange for a signed pardon, or a big payoff. Control of Gulf coast loot was Cheney's price for not ratting on Bush Jr. on Treasongate. (And he already had a pardon, signed way back, with spaces left blank for assorted felonies; what he wanted now was more loot, to pad his security for the aftermath.)

Rove put out a medical cover story, too--his kidneystone problem--to explain (after the fact) his disappearance during Katrina. He may also have got in on the Katrina loot/Treasongate blackmail (news story that he was put in charge of doling it out to their buds).

But I think they were working at odds (Rove, Cheney), and that we were looking at a house very divided. Very wobbly. A bit stabler now. Some deals made. Who's going to take the fall? Libby? Maybe Cheney himself (age, illness, cane, vast power to fend off jail).

You see, I think there is something behind Treasongate that is much worse than their wanting to "punish" a dissenting ex-diplomat for his opinion piece. Of course the Iraq war itself is much worse, but we all know about that. My guess: A secret plot to PLANT WMDs in Iraq, to be "found" by Judith Miller. Not just lies, but naked deceit in a very concrete form. I think that's why Plame was outed. I think that's why David Kelly (Brits chief WMD expert) was killed four days after Plame was outed. I think they foiled the plot--or knew enough about it to be very dangerous to the Bush regime.

Treasongate is the coverup of the coverup. The cover story of Rovian revenge in punishing Wilson for his article was a coverup of Bush Cartel revenge against the CIA for CIA foiling their nasty scheme to plant WMDs in Iraq. They had set Wilson up--with Niger wild goose chase, based on forged docs--to discredit the CIA when the phony, planted WMDs were "found." David Kelly found out about it through his contacts in Iraq. He did not intend to reveal the worst, but he had been whistleblowing anonymously to the BBC about "sexed up" Iraq WMD intel. He was mysteriously outed to his bosses, and interrogated, and Tony Blair was informed, on July 7, 2003 (seven days before the Plame outing) that Kelly "could say some uncomfortable things"--could say, not HAD said. After Kelly's highly suspicious death, on July 17, 2003, and his office and computers were searched, Novak then, on July 22, outed the CIA's entire WMD monitoring project (Brewster Jennings), very likely getting some of its network of covert contacts killed, and disabling all projects.

I think the Bushites were acting in a panic--to disable, silence, punish and finish off the CIA--after Tony Blair warned them (July 7) that Kelly knew about their WMD-planting scheme, and that the CIA had something to do with foiling it. During that week--July 7-14, 2003--they contacted at least SIX reporters (journalist witnesses to treason), and did other things that put many top Bushites at great risk of treason charges. A rush, a panic, to get her outed and get that operation shut down NOW. A panic and a rage--but not Rove's (a mere operative). Cheney's. Their master plan for justifying Iraq, and for discrediting the CIA, foiled, destroyed. And they would be backfilling, and lying, and covering up forever more.

Anyway, that's my theory of Treasongate. I think it went far beyond violating the Espionage Act. And I think that's why Judith Miller (whom I suspect of being thick in the middle of both outings--Plame and Kelly--and of the weapons planting plot itself) wanted to limit her testimony to the Grand Jury, to conversations with Libby.

His "aspens" letter to her is interesting in this respect. He says he he wants her to testify--and has all along (uh-huh). He assures her that the "aspens"--the real coverup?--is deeply rooted (they are protected from the worst?) ("they turn in clusters because their roots connect them"). He may have also signaled that he is the one taking the fall, and he's doing it willingly. ("You went to jail in the summer. It is fall now....Out West, where you vacation...." = I am now going to take the fall, in jail, like you, i.e., where you have been "vacationing"--out of the loop, in the wilderness?)

But then he assures her that "suicide bombers, biological threats and the Iranian nuclear program" WILL BE news (that she should "come back to work--and life" to report on). Meaning? They now have a plan for major distractions from the GJ indictments? That certainly sends ice chills through one's soul. A major epidemic here, nukings in the Middle East, more bombings--and who would care about violations of the Espionage Act, or bother to investigate it further?

Or it could also mean that the threat to HER life has been put in abeyance, and that "business as usual" has been restored. The threats, the deals, the AWOLs, the blackmailings, the fall guys, the limitations of the investigation, etc., have all been settled. And you can go back to your job at the NYT, spreading our lies. (Or, we have lined up a similar job for you elsewhere.)

Makes me think Cheney will be an "unindicted co-conspirator," and will resign to prevent any (is it even conceivable?) Congressional investigation. Libby will do time (waived a Bush pardon to protect Cheney and the Cartel). Rove? Dunno. Probably in on the deal for Libby to take the fall. Somebody has said that Bush can't pardon Rove. I don't know what the arguments are for that. But it sure looks to me like Rove negotiated a pardon or SOMETHING (during Katrina). His "lost email" may exonerate him and point to Libby (all agreed upon). Bush Jr. will get off scott free. So will Rumsfeld, probably (who personally signed Judith Miller's "embed" contract to "hunt" for WMDs in Iraq, that they all knew weren't there). Rumor has it that Rumsfeld will resign soon. ("Mission accomplished!"--billions and billions and billions of dollars stuffed into the pockets of his and Cheney's friends; the US military shattered and in disarray; the UCMJ in tatters; everything in the hands of private interests and mercenaries.)

As for the future, the Republicans really have nothing to worry about. They have Diebold's and ES&S's "TRADE SECRET," PROPRIETARY programming code in all the new electronic voting systems to fall back on, unless the American people decide to throw these election theft machines into 'Boston Harbor,' which I sincerely hope and pray we do.

We may have David Kelly and the "good CIA" to thank for that opportunity. (Can you imagine what it would be like now, politically, if they had SUCCEEDED in planting WMDs in Iraq?)

10. Learning from History
Being so near-synched with Miller's "found" notes, this event worries me. Intent on some exchanges on this I have posted similarly elsewhere on DU. Rarely in the reporting and commentary on issues of this sort, here, elsewhere in c'space, or in corporate media, is there much if any discussion of the issue of veracity of the key exhibits.

We have seen examples of tainted/forged documents recently (yellowcake memo and Rathergate come to mind), with varied and creative sinister purposes behind them. The Rather episode stands out.

It seems easy to cobble together freewheeling notes, memos, and emails after-the-fact, with complete freedom to concoct contents for any number of vile objectives. Possibilities that come to mind include impugning the credibility of public figures or journalists, fuzzifying the historical record, or offering a distraction for the ongoing cacophony of evil spirits coming home to roost in the white house.

Presumably in trial settings efforts are routinely made to check on and document the bona fides of critical bits of documentation. In the meantime though, out here where we must do our own newsgathering and fact-checking if we really want to stay in touch and be anything like current (thanks * and MSM for that vital lesson!), it seems more care and skepticism is needed.

I'm seeking insights from those with working experience in professions like journalism and law enforcement. How hard would it be to fake a helpful email after the fact, and what are the chances of us getting conned by weakly-documented or even wholly uncorroborated documents like the Rove email?

14. That would be an extremely high-risk strategy - chances of getting
caught would be very high because you'd have to get several people to conspire to forge such an e-mail. That includes the sender, the recipient, and a highly skilled technical person to insert it into a system that's very secure and backed up. That technical person would have to know how to get into all the servers and into the file storage of the outside data repository.

In a word, unlikely.

hard-drives that would be dispositive. They might try to hack the WH e-mail system (and the taped data stored off the premises) after the fact, but I bet that would be about the most challenging hack one could possibly pull off.

In fact, any effort to modify or erase the e-mail exchanges within that system without leaving a detectable trace is hard to imagine. However, such an attempt would be quite good evidence of obstruction of justice.

36. Thanks for these observations...
We have seen examples of tainted/forged documents recently ( memo and come to mind), with varied and creative sinister purposes behind them.

I agree, however, I would imagine Fitzgerald is not anything like the Corporate Media. To pull this kind of stunt for a pool of bubble-headed "reporters" is one thing, but to try it on a professional, intelligent prosecutor who, by all accounts, is hellbent on finding the truth is quite another kettle of fish. I imagine if BushCo is attempting to "Ratherize" Fitzgerald, they are 1) extremely stupid; 2) extremely desperate; or 3) a little of both. Anyway, they are not the clever, crafty group they were made out to be 5 years ago...

By the way, welcome to DU! :hi:

44. The Rather episode stands
Are you suggesting that the Memo Rather was relying on was forged and if so what proof of this do you have. The only thing I am aware of is Rather did not have the memo authenticated as original. Nobody as far as I have been able to determine has suggested the material on the Memo was false. Even Bush* does not deny it. Yes there was a big to do about it but no evidence of wrong doing was ever presented to my knowledge.

12. Rove's email to Hadley was in the press after Cooper testfied on July 13.
Now it's "news" again because Rove is testifying and Isikoff wrote his article like it was a scoop.

Here's July 17, 2005 AP article about the email: http://www.washtimes.com/national/20050717-121150-3026r.htm After reading that article wanna bet Rove/Luskin camp leaked the email to the AP? To get their spin into the press after Cooper's testimony?

The Rove email as reported strikes me as a CYA thing. To get the story down, something one keeps in one's pocket so to speak, just in case it ever becomes necessary to establish/document a story line. Later, when circumstances appear to warrant it, turn it over and publicly leak it when it can be of use.

Except Cooper's testimony, as noted in his July 25 article http://www.time.com/time/archive/preview/0,10987,1083899,00.html , contradicts Rove's story line and other articles then came out (seemingly in response to the Rove email story) noting that Rove early in the investigation and in his initial grand jury testimony neglected to mention that he spoke to Cooper and he only belatedly in 2004 turned the email over to the prosecutor. Have to wonder who leaked those particular nuggets to the press. Assuming it's not the tight lipped prosecutor's office or investigators which seems unlikely, then it's dueling WH camps, jockeying for position and spin.

Which is why the widely noted recent Isikoff/Newsweek article isn't a scoop but a refresher prior to Rove's 4th trop to the GJ.

It's beginning to look a lot like Fitzmas
Everywhere you go.
Who's gonna do five-or-ten?
We're thinking once again
Of handcuffs and of orange jumpsuits aglow.
It's beginning to look a lot like Fitzmas
Indictments on every score
But the prettiest sight to see
Is the scowl on Darth Cheney
At the slammer's front door.

A warrant or writ, a subpoena that fits
Is the wish of Barney and Ben;
The thought of Turdblossom hung up like a possum
Is the hope of Janice and Jen;
And Mom and Dad can hardly wait for court to start again.

It's beginning to look a lot like Fitzmas
Everywhere you go.
There's an defendant who doesn't want to tell;
One in the White House as well --
The felony kind that doesn't mind the law!
It's beginning to look a lot like Fitzmas
Soon the bells will start
And the thing that will make them ring
Is the indictment that we sing,
Right within our hearts!

But in this administration, there are SOOO many cesspools, and so many layers of slime in each one.

I don't think this will stop them. At least, it won't stop the handlers that are behind the "think tanks" and money bags that support this kind of slime...that in fact insist upon this type of slime being in power.

Just so long as the handlers get their way, and are allowed to break the backs of the labor force to put us all in our place, they'll keep putting people like the bush crime family in front, and paying for the loyalty of the clintons & clones in the DLC.

Right now, we have an abundance of people in elected office that are so totally bought and paid for, that it boggles the mind. These people are throwing the average American into a black hole....A "Silence of the Lambs" type black hole comes to mind.

41. Did the bushistas have any choice about Fitzgerald's appt.?

Either they did not know about him, or they had to accept him.
