When a power plant upgrades, the company is required to add pollution filters.
But what is an upgrade and what is routine maintenance?
To make the air cleaner, experienced EPA official Sylvia Lowrance, deputy assistant administrator for enforcement, proposed on June 3, 2002, that when a company spends at least .75% of the value of the plant on upgrades within a year, adding pollution filters be a requirement.
However, on August 27, 2003, the Bush Administration announced it was setting the threshold at 20% instead (more than 25 times the recommendation of experienced EPA official Sylvia Lowarance). This means a company with a billion dollar power plant which spends less than $200 million on upgrades within one year is exempt from adding pollution filters.
