How does the court enforce its decisions in Terri Schiavo case |
|
Edited on Thu Mar-24-05 11:08 AM by Spinzonner
Andrew Jackson once famously said (regarding Justice Marshall):
"John Marshall has made his decision. Now let him enforce it."
If Jeb Bush chooses to send in state authorities to take custody of Terri with the intent - or act - of reinserting the feeding tube, what tools do the state courts have of counteracting those actions ?
And what can Jeb counteract it with ?
Will this lead to a state Constitutional crisis and is there a role for the Federal Government to intervene in such a case and what actions are the Federal authorities to take. Would it be the administration or the Federal courts ?

to do that, I believe the President would be compelled to order the US Atty General to stop his actios; Send in the Guard or federalize the local police and order them to sustain the SCOTUS ruling.
At least I think that is how it works...

2. I believe Greer had state police in the door yesterday-- |
|
They blocked Jebbie's minions from placing Terri under protective custody--people from state social services, I believe (you know, the ones that keep losing foster children...).

4. Jebbie's big brother would have to send in troops |
|
because Jebbie's actions would be illegal in a lot of ways. Wouldn't THAT be interesting.

5. Good historical reference... |

I think that was a case involving the removal of Indians from their land in Georgia. Course in those days the recognized authority of the court was still in flux!
